1. Acceptance of Terms
By accessing or using Markday (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Markday and is available at markday.ashketing.com.
2. Description of Service
Markday is an online drawing education platform that provides structured lessons and AI-powered feedback on uploaded sketches. The Service includes free and paid tiers with varying levels of access to lessons and feedback sessions.
3. User Accounts
You must create an account to use certain features. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate information and be at least 13 years old to use the Service.
4. User Content
You retain ownership of sketches you upload. By uploading content, you grant Markday a limited license to process, store, and display your sketches for the purpose of providing feedback and displaying them in your account. You may delete your content at any time. You must not upload content that is illegal, harmful, or infringes on others' rights.
5. AI Feedback
AI feedback is generated by third-party AI models and is provided for educational purposes only. While we strive for helpful, accurate feedback, AI-generated content may contain errors or subjective opinions. Markday does not guarantee the accuracy or completeness of AI feedback.
6. Payments and Subscriptions
Paid subscriptions are billed through Stripe. Monthly subscriptions renew automatically each month. Annual subscriptions renew automatically each year. You can cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. Refunds are available within 7 days of initial purchase.
7. Prohibited Conduct
You may not: reverse engineer the Service, use the Service to develop competing products, upload malicious content, attempt to access other users' accounts, or use automated tools to scrape or interact with the Service.
8. Intellectual Property
The Service, including its design, code, content, and brand elements, is owned by Markday. Lesson content, AI feedback prompts, and curriculum structure are proprietary. You may not reproduce or distribute Markday's content without permission.
9. Limitation of Liability
Markday is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 12 months prior to any claim.
10. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email or notice on the website. Continued use after changes constitutes acceptance.
